Injunction/Prohibition
If the employer does not comply with what it says in the inspection notice, the Work Environment Authority can issue him or her with an order to take a certain measure, e.g. improve the ventilation.
Some machines and other technical equipment, working methods or a facility may present such great risks to the employees that they must not be used, in which case the Authority can issue a prohibition until the measures indicated have been taken.
Anyone contravening an injunction or prohibition can be punished for doing so. In its order the Authority can set a contingent fine, to be imposed if the injunction or prohibition is not complied with. Normally, before an injunction or prohibition can be decided on, a new inspection is needed to check whether the deficiencies remain.
A party complying with the stipulations never risks having to pay the contingent fine.
